Commerce Commission welcomes ruling
The Commerce Commission has welcomed a ruling upholding a decision against Telecom for over-charging its competitiors.
The Court of Appeal decision upheld an earlier High Court ruling, which found Telecom unlawfully took advantage of its market power to charge high prices for wholesale access to its network.
That prevented competitors from offering high-speed data services at a competitive rate.
Justice Susan Glazebrook dismissed Telecom’s appeal, saying the breach was significant.
She said evidence indicated Telecom’s philosophy was to avoid price competition.
